New Home Office policy on Conditions of support On 2 June the Home Office published a new policy on illegal working as a breach of asylum support conditions.

The government made changes to the asylum support regulations, introducing a new rule that working illegally would breach the conditions of support. Changes to s95 rules came into force on 27 March and are expected to do so on 2 June for s4 support.

On the 2 of June the Home Office published Illegal working as a breach of asylum support conditions policy. This policy outlines how the Home Office will investigate cases where they suspect illegal working and when they will decide to suspend or discontinue support as a result.

There is a right of appeal to the Asylum Support Tribunal on a decision to discontinue support due to a breach of conditions. See our new factsheet on breach of conditions (asylum support).

The Home Office has explained that the purpose of these new rules is to make easier for them to investigate breach of conditions and send a stronger message that working illegally has consequences.
